Divorce mediation is used to help couples solve their differences without entering a courtroom. The mediation is between the two spouses, the mediator, and the lawyers of each spouse (only if asked to come by spouses). The mediator is always neutral and is instructed not to sway one way or the other. Mediators are not lawyers, their only job is to help the couples understand what it is they want and how to arrive there without all of the bickering and the drawn out court dates.

The couples are given this opportunity (which is optional and not required) so that they can decide everything they want to do (custody and property) privately. The spouses will negotiate the terms that are set forth and if the mediation is done right they will come to an agreement with little to no harsh words. However, some mediation sessions don’t work and the couple chooses to take things to court instead.

Many couples are encouraged to take advantage of mediation because it helps the couple to stay on friendly terms (for the children). It also helps them to keep their differences away from any children who are involved.
